The University Hospitals Fertility Center of Ahuja Medical Center acted failed to control the temperature of storage freezers which were storing human embryos and eggs. As a result, these embryos thawed and are now likely no longer viable. This tragic misstep was made even worse by a lack of action on behalf of hospital personnel, and the once-hopeful parents will now never have a chance for the children they dreamed of.
It is alleged that University Hospitals failed to accurately observe the nitrogen storage tank which contained the frozen embryos and eggs, as well as failed to uphold proper policies to protect the embryos and eggs from any environmental control malfunctions or tampering of the storage tanks and freezers. The plaintiffs are also alleging University Hospitals failed to preserve the human embryos and eggs in a functioning condition, as per the contracts signed by both the University Hospitals and their patients.
Not only has this caused significant monetary loss in regard to the amount paid for the contract, loss of the value of the human embryos, as well as future economic damages--but this lawsuit is also pursuing economic loss as a result of the loss of property.
